The separation of powers between the parliament and the courts is critical to our structure of government and rule of law. It is right that the NSW State Labor government and the Greens resisted the call of MP Tania Mihailuk to compromise the independence of the Office of the Department of Public Prosecutions with an Upper House investigation (“NSW deserves better than flawed Hayne prosecution”, DT Opinion, 13/6).The quashing of the Hayne conviction by the Court of Criminal Appeal was based on errors from the bench, not the prosecution. While DPP Sally Dowling may have challenges as she navigates past the “me-too” movement and new consent laws, she must find a balance while retaining independence from political influence.
